La dimensión sociológica de la juridicidad originaria del Código Civil y Comercial

Abstract

Se considera la juridicidad originaria del Código Civil y Comercial. Para ello se utilizan las categorías de la dimensión sociológica de la construcción integrativista tridimensionalista de la teoría trialista del mundo jurídico. Dichas categorías parten de las adjudicaciones de potencia e impotencia, es decir de lo que favorece o perjudica a la vida humana. Pueden desarrollarse mediante distribuciones de la naturaleza, las influencias humanas difusas o el azar o repartos originados por la conducción de seres humanos determinables. Las influencias humanas difusas son producidas por ejemplo por la economía, la religión, la lengua, la ciencia, etc.

This paper considers the juridicity source of the Civil and Commercial Code. To that end, we use the sociological dimension’s categories of the three-dimensional integrativist construction of the trialist theory of the juridical world. These categories are based on allotments of power and powerlessness, that is, what helps or harms human life. They can be developed through distributions of nature, diffuse human influences or the chance; or through partitions originated in determinable human conducts. The diffuse human influences are produced, e.g., by the economy, religion, language, science, etc.
